1. CONTRACT BETWEEN US
By placing an order on our Website you accept these Terms and Conditions. We reserve the right to make changes to these Terms and Conditions at any time. The Terms and Conditions, and prices, shown at the time your order is placed will apply.
2. PAYMENT
We must receive payment in full for the goods, and the delivery costs, before your order can be processed. Once payment has been received we will confirm that your order has been accepted by sending an email to the email address you advise us in your order. Our acceptance of your order will create a legally binding Contract between you and Aperture Records Ltd.
3. PRICE
The prices payable for goods that you order are as set out in our Website. All prices on the website are V.A.T. inclusive unless otherwise stated. Delivery charges are in addition to the prices shown for goods. Basic delivery charges are set out in our Website. Additional costs for sending out more than one item will be supplied on request.
4. RIGHT TO CANCEL YOUR CONTRACT AND REFUND POLICY
You may cancel your Contract with us at any time up to and including the end of the seventh working day from receipt of our email confirming your order or from receipt of the goods if they have already been dispatched (whichever is the longer) being the cooling off period. You do not have to give us a reason for cancelling your Contract and you do not have to pay any penalty. To cancel your Contract you must notify us by email to info@aperturerecords.com. If you cancel your Contract with us and we have already sent the goods out you must not unpack the goods when they are received by you and must send them back to us at your own cost and risk in the same unopened package as they were sent in. If you receive the goods and open the package we will not be able to accept a cancellation of the Contract unless the goods are faulty. Once you have notified us that you are cancelling your Contract with us, and we have received the goods back in the same condition as they were in when dispatched to you, we will credit your account with any sum deducted from your credit card for the goods and our delivery costs as soon as possible and in any event within thirty days of the acceptance of your order. If the goods are faulty we will also refund the cost of returning them back to us.
5. CANCELLATION OF CONTRACT BY APERTURE RECORDS LTD.
We reserve the right to cancel the Contract between us if:
(a) we have insufficient stock to deliver the goods you have ordered or
(b) we do not deliver to your area
If we cancel your Contract with us we will notify you by email and we will credit your account with any sum deducted from your credit card as soon as possible and in any event within thirty days of the acceptance of your order. No additional compensation for disappointment suffered will be paid.
6. DELIVERY OF GOODS TO YOU
We will deliver the goods ordered by you to the address you give us for delivery at the time you place your order. Delivery will be made as soon as possible after your order is accepted and in any event within thirty days of accepting your order. You will become the owner of the goods when they have been delivered to you. The goods will then be held by you at your own risk and we will not be liable for their loss or destruction.
7. LIABILITY
If the goods we deliver to you are not what you ordered or are damaged or defective or the incorrect quantity has been delivered we shall have no liability to you unless you notify us by email to info@aperturerecords.com of the problem within ten working days of the receipt of the goods. If you do not receive the goods ordered within thirty days of the date we accepted your order we will have no liability to you unless you notify us by email to info@aperturerecords.com of the non-delivery within forty days of the date we accepted your order.
If you notify us of a problem our only obligation will be at your option:
(a) to make good any shortage or non-delivery, or
(b) to replace any goods that are damaged or defective, or
(c) to refund to you the amount you paid for the goods in question in whatever way we choose.
Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expense (including loss of profits, business or goodwill) howsoever arising out of any problem you notify to us under this clause and we will have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question.
You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our Website. The importation or exportation of our goods to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the import or export of the goods you purchase.
Notwithstanding the foregoing, nothing in these Terms and Conditions is intended to limit any rights you may have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.
8. NOTICES
Unless otherwise stated in these Terms and Conditions all notices from you to us must be sent to us by email to info@aperturerecords.com and all notices from us will be sent to you at the email address you give us at the time of your order.
9. EVENTS BEYOND OUR CONTROL
We shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.
10. INVALIDITY
If any part of these Terms and Conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these Terms and Conditions will not be affected.
11. PRIVACY AND LEGAL POLICY
You acknowledge and agree to be bound by the terms of our Privacy and Legal policy.
12. THIRD PARTY RIGHTS
Except for our directors, employees or representatives, a person who is not a party to this agreement has no right under the United Kingdom Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement but this does not affect any right or remedy that exists or is available apart from that Act.
13. GOVERNING LAW
The contract between us shall be governed by and interpreted in accordance with English law and the English courts shall have jurisdiction to resolve any disputes between us.
14. ENTIRE AGREEMENT
These Terms and Conditions, together with our current Website prices, delivery details, contact details and Privacy and Legal policy, constitute the whole of our agreement relating to the supply of goods to you by us. Nothing said by any sales person on our behalf should be treated as a variation of these Terms and Conditions or as an authorised representation about the nature or quality of any goods offered for sale by us. Save for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading.
